Still Kickin’ – Terms of Use

1. Acceptance of Terms
By downloading, accessing, or using Still Kickin’ (“the App”), you agree to be bound by these Terms of Use. If you do not agree, you must not use the App.

2. Important Disclaimer – Not an Emergency Service

Still Kickin’ is NOT an emergency service.

• The App is not designed, intended, or guaranteed to save lives.

• The App does not contact emergency services (e.g., 911).

• The App does not provide medical, safety, or emergency response services.
  
  

In the event of an emergency, you must call 911 (or your local emergency number) immediately.

You acknowledge and agree that:

• The App is a companion tool only, intended to provide optional check-in reminders and notifications to contacts you choose.

• The App must not be relied upon for personal safety, emergency response, or life-saving purposes.

• Delays, failures, or missed alerts can and will occur, and you accept this risk.

3. Changes to Terms
We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms.

4. Eligibility & User Responsibilities

• You must be at least 13 years old to use the App.

• You are responsible for maintaining the security of your account and device.

• You agree to provide accurate information when using the App.
  
  

You are solely responsible for:

• Setting up reminders correctly

• Maintaining internet connectivity and device functionality

• Ensuring your contacts are valid and reachable
  
  

5. App Functionality & Limitations
Still Kickin’ provides features such as:

• Scheduled check-in reminders

• Notifications to designated contacts if a check-in is missed
  
  

However, you acknowledge:

• Notifications may be delayed, fail to send, or never be delivered

• Third-party services (e.g., SMS, email, voice providers) may fail

• Device issues (battery, connectivity, settings) may prevent operation
  
  

We make no guarantees that alerts will be sent, received, or acted upon.

6. Permitted Use
You agree not to:

• Use the App for unlawful purposes

• Attempt to reverse-engineer or exploit the App

• Misuse alert systems or provide false emergency-related information
  
  

7. Privacy
Your use of the App is also governed by our Privacy Policy. We handle user data in accordance with applicable laws and our stated practices.

8. Intellectual Property
All content, design, branding, and functionality of Still Kickin’ are the property of YO! JAMES, LLC and are protected by applicable laws.

9. Disclaimer of Warranties
The App is provided “as is” and “as available.”

We make no warranties, express or implied, including:

• Fitness for a particular purpose

• Reliability or availability

• Accuracy or timeliness of alerts
  
  

10. Limitation of Liability
To the fullest extent permitted by law:

• We are not liable for any injury, harm, loss, or damages, including but not limited to:

  • Personal injury or death

  • Missed check-ins or failed alerts

  • Delays in notifications

  • Reliance on the App for safety or emergency situations

You expressly agree that use of the App is at your sole risk.

11. Indemnification
You agree to indemnify and hold harmless YO! JAMES, LLC from any claims, damages, or liabilities arising from:

• Your use or misuse of the App

• Your reliance on the App in emergency situations

12. Termination
We may suspend or terminate access to the App at any time, without notice, for violations of these Terms or for any reason.

13. Governing Law
These Terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the appropriate courts of that jurisdiction.
